These Terms of Service ("Terms") govern access to and use of the Refractia platform, products, and services (collectively, the "Service"), operated by Refractia ("Refractia," "we," "us," or "our").

By accessing or using the Service, you ("User," "you," or "your") agree to be bound by these Terms.

1. Description of the Service

Refractia provides analytical tools designed to evaluate patterns, tendencies, and variations in outputs generated by large language models ("LLMs") in response to structured prompts.

The Service analyzes publicly observable AI-generated outputs to identify trends in how brands, organizations, and public figures are described, compared, or referenced by AI systems at a given point in time.

Refractia does not provide access to, modify, or influence the internal mechanisms, training data, or decision-making processes of any AI model.

2. Independence from AI Providers

Refractia is an independent platform and is not affiliated with, endorsed by, sponsored by, or acting on behalf of OpenAI, Google, Microsoft, Anthropic, or any other AI provider.

Any references to third-party AI systems (including but not limited to ChatGPT, Gemini, Claude, or Bing AI) are for descriptive purposes only and relate solely to publicly available or officially supported APIs or interfaces.

3. Nature and Limitations of the Analysis

3.1 Observational Analysis Only

All insights, metrics, reports, and recommendations provided by the Service are derived exclusively from observable AI-generated text outputs produced at the time of analysis.

Findings represent patterns of model behavior, not factual assertions, endorsements, opinions, or intent of any AI provider.

3.2 No Claims Regarding Internal AI Systems

Refractia does not claim to:

  • access proprietary training data
  • infer internal model weights or architecture
  • reveal confidential or protected sources
  • predict future behavior of AI systems

4. Prohibited Uses

You agree not to use the Service to:

  • bypass, evade, or undermine safeguards, filters, or policies of any AI system
  • scrape or automate consumer-facing AI interfaces
  • impersonate individuals or organizations
  • generate deceptive, misleading, or fraudulent content
  • attempt to manipulate or control AI systems
  • violate applicable laws, regulations, or third-party terms
  • submit malicious inputs, including prompt injection attempts, code exploits, or misleading instructions

Refractia reserves the right to suspend or terminate access for violations of this section.

5. No Guarantee of Outcomes

Refractia does not guarantee that:

  • any brand, organization, or individual will be recommended by AI systems
  • observed patterns will persist over time
  • any action taken based on the Service will result in a specific outcome

AI systems operate independently and may change without notice.

6. Premium Analyses and Large-Scale Prompting

Certain offerings involve large-scale structured prompt execution and aggregated analysis ("Premium Analyses").

Premium Analyses:

  • evaluate consistency, variation, and response behavior across multiple contexts
  • provide aggregated, interpretive insights, not authoritative statements
  • do not resell or redistribute raw AI-generated outputs beyond analytical transformation

Refractia retains ownership of its analytical frameworks, methodologies, and derived insights.

7. Use of Results and Disclaimer

The Service is provided for research, analytical, and strategic planning purposes only.

The Service is not intended to provide legal, medical, financial, regulatory, or professional advice.

You agree not to rely on the Service as the sole basis for decisions requiring professional judgment.

8. User Responsibility

You are solely responsible for:

  • the accuracy of information you provide to the Service
  • how insights are interpreted and applied
  • compliance with applicable laws and third-party obligations

9. Intellectual Property

All intellectual property related to the Service, including but not limited to:

  • software
  • methodologies
  • prompt architectures
  • scoring systems
  • reports and visualizations

are owned by Refractia or its licensors.

You may not copy, reproduce, or reverse engineer any part of the Service without written permission.

10. Data and Privacy

Use of the Service is subject to Refractia's Privacy Policy.

Refractia does not claim ownership over User-provided data but may process such data to provide the Service.

11. Termination

Refractia may suspend or terminate access to the Service at any time for:

  • violation of these Terms
  • misuse of the Service
  • legal or regulatory requirements

Upon termination, your right to use the Service ceases immediately.

12. Limitation of Liability

To the maximum extent permitted by law:

Refractia shall not be liable for:

  • indirect, incidental, consequential, or special damages
  • loss of profits, data, or business opportunities
  • inaccuracies or changes in AI-generated outputs

The Service is provided "as is" and "as available."

13. Indemnification

You agree to indemnify and hold harmless Refractia from any claims, damages, losses, or expenses arising from:

  • your use of the Service
  • your violation of these Terms
  • your misuse of insights or outputs

14. Changes to the Terms

Refractia may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
